The ninth circuit court has upheld a ban on deploying national guard in Portland, Oregon, after a latest legal decision.

Judicial Panel Concurs to Reconsider Case

The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the executive power with an larger group of eleven justices. The judicial body also overturned a previous decision from a smaller judicial group that had supported the federal government.

Ongoing Dispute Over Troop Deployment

This order represents the most recent development in a protracted legal battle over whether the former president has the legal right and justification to deploy state military units in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that government employees at the immigration center in south Portland were facing threats, while local authorities assert that municipal police have command of the situation.

In defiance of characterizations of Portland as a conflict zone, locals have been sharing videos of lush hiking trails and a vibrant culinary culture, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a federal judge in the city issued two temporary restraining orders this month – one preventing the federalization of the Oregon national guard, and another prohibiting the deployment of any national guard troops in the state, after attempts to circumvent the initial injunction by mobilizing out-of-state forces.

On the previous day, the appeals court had put the first ruling on hold – allowing control of state troops – but the subsequent injunction stayed effective, blocking the physical sending of the forces.

En Banc Review

The latest ruling means the matter will be heard by the full court – with both rulings under review simultaneously – by a group of eleven justices.

“This decision demonstrates that facts are important and that the judicial system are working to hold this administration accountable. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for expansive government power,” stated the state attorney general in a statement.

“The judicial body is sending a clear message: the president cannot send the military into US cities without cause. We will continue protecting Oregon’s laws, values, and sovereignty as this legal proceeding moves forward and our fight continues in the courts.”
